Provider: Banana Digital ("we", "us", "our")

Client: The individual or business accepting this offer ("you", "your")

1.Definitions

1.1 "Page" means a single, unique web page with its own URL and distinct content. For clarity, each of the following is counted as one Page:

A parent or "listing" page that simply links to child pages (e.g. a Services overview showing cards that link to individual service pages) counts as one Page. Each child page sitting beneath it counts as an additional Page.

1.2 "Base Package" means the 5-page website described in clause 2.

1.3 "Extra Page" means any Page beyond the five included in the Base Package. Extra Pages are available individually or as part of a bundle pack — see clause 3.

1.4 "Content" means text, images, logos, videos, brand assets, testimonials, pricing, and any other material you supply for inclusion on your website.

1.5 "Complete Content Submission" means the moment you have provided, in one consolidated submission or shared folder, either (A) final written copy for your site, or (B) a short copywriting brief for us to write the copy on your behalf (see clause 2.4), together with all of the following:

Content or briefs that are incomplete, unusable, illegible, low-resolution, or materially out of scope do not constitute Complete Content Submission. We will notify you in writing of any missing items, and the Complete Content Submission timer only begins once all items have been received in a usable form.

1.6 "First Draft" means the initial design mockup of the Home page of your website, presented for review via a link, image, or staging URL. The First Draft does not include fully styled inner pages, final imagery placement, or functional integrations, which are completed in subsequent stages of production.

2.The Offer

2.1 For $500 + GST, we will design and build a 5-page website consisting of: Home, Services, Gallery, About, and Contact / Book.

2.4 Copywriting scope. The Base Package includes basic on-page copy for all five pages. You may choose one of two options at the start of the project:

In either case, you are free to edit the copy yourself. If you would like us to make changes to the draft, those changes fall within your two (2) included rounds of revisions under clause 7. Heavy rewrites, repeated re-briefs, long-form content, or SEO-specialised copywriting beyond what is described above are quoted and charged separately. Basic keyword-rich copy for Extra Pages is included in the Extra Page pricing set out in clause 3.

2.5 First Draft Guarantee. Your First Draft (as defined in clause 1.6) will be delivered within two (2) business days of Complete Content Submission. If we fail to deliver the First Draft within this timeframe, you will receive a $100 credit, applied as a refund to the card used for payment.

2.6 Guarantee conditions. The First Draft Guarantee:

"Business days" means Monday to Friday, excluding public holidays in the state listed in clause 15.1.

3.Extra Pages & Scope Changes

3.1 Extra Page pricing. Extra Pages are available individually or in bundle packs. All Extra Pages include basic keyword-rich copy written by us (approximately 150–300 words per page, produced from your copywriting brief and optimised for local service-related search terms).

3.2 Pack terms. Bundle packs (Service Page Pack, SEO Power Pack) must be purchased up-front as a single transaction, alongside or shortly after the Base Package, to qualify for the pack pricing. Extra Pages added individually during or after the build are charged at the individual rate of $100 + GST each. Pack pricing is not retroactive and bundle packs are non-refundable once work on any page in the pack has commenced.

3.3 Examples of work that counts as an Extra Page include (but are not limited to):

3.4 Scope changes. Changes requested outside the agreed scope (including additional functionality, integrations, custom design work, or revisions beyond the included two rounds) will be quoted separately at our standard hourly rate of $200 + GST per hour, payable before the work commences.

4.Payment Terms

4.1 The total fee of $500 + GST is payable in full via Stripe at the time of accepting this offer, before any design or development work begins. Payment is a single, one-time charge.

4.2 By accepting this offer you authorise Banana Digital to process this charge, and to store your card details via Stripe for any future charges you agree to in writing (for example Extra Pages, add-ons, hosting renewals, or the $100 credit under the First Draft Guarantee if it becomes payable). Card details are processed by Stripe in accordance with PCI-DSS standards; we do not directly store your full card number.

4.3 If your card is declined, the offer is not accepted and no services will be delivered until a successful payment is processed.

4.4 Extra Pages, add-ons, and third-party costs are quoted separately, approved in writing, and charged before the relevant work begins.

4.5 All amounts are in Australian dollars and exclusive of GST unless stated otherwise. GST is added at the prevailing rate.

4.6 Chargebacks. If you have a concern or dispute about the charge, you agree to raise it with us in writing first and give us a reasonable opportunity to resolve it, before initiating a chargeback or card dispute with your bank or card provider. If a chargeback is filed without first contacting us to attempt resolution, you agree to reimburse any reasonable costs, fees, or losses we incur as a direct result, and we may suspend or cease work until the matter is resolved.

5.Your Responsibilities & Content Deadline

5.1 You are responsible for supplying all Content required for your website, including written copy, images, logos, service lists, pricing (if displayed), and staff details.

5.2 Complete Content Submission (as defined in clause 1.5) must be provided within 7 days of payment being received.

5.3 If Complete Content Submission is not provided within 7 days:

5.6 Unresponsiveness during the project. If, at any stage after work has commenced, you fail to respond to a request from us for feedback, approval, content, or information for a period of 14 days, we may:

6.Timeline

6.1 The First Draft is delivered within 2 business days of Complete Content Submission under the First Draft Guarantee (clause 2.5).

6.2 The completed website is typically delivered within 5–10 business days from Complete Content Submission. This is a good-faith estimate, not a guarantee.

6.3 Delays caused by late Content, slow feedback, revisions beyond the included rounds, or scope changes are not our responsibility and will extend the timeline accordingly.

7.Revisions

7.1 The Base Package includes two (2) rounds of revisions on the design.

7.2 A "round of revisions" means a single consolidated list of changes submitted by you after reviewing the draft site. Requests submitted piecemeal may be treated as multiple rounds.

7.3 Additional rounds are charged at $100 + GST per round, or quoted at our standard hourly rate of $200 + GST per hour for larger changes.

7.4 Revisions are limited to adjustments within the agreed design direction. Re-designing the site after initial approval is out of scope and quoted separately.

8.Hosting, Domain & Ongoing Costs

8.1 Hosting for the first 12 months from launch is included. After that, hosting renews at our then-current rate (currently $22 + GST per month, or $132 + GST per year paid annually in advance — a 50% saving on the monthly rate). You will be notified before any renewal.

8.2 Domain names are registered and owned by you. Annual domain renewal fees are paid directly by you to the registrar.

8.3 Platform portability. Your website is built using the website builder tools of our chosen platform (currently HighLevel or similar). Sites built on this platform are not exportable as standalone files to other website platforms (such as WordPress, Webflow, Squarespace, or custom hosting). If you cancel hosting with us, we can:

We cannot provide the site as downloadable HTML, CSS, or a fully functional self-hosted file set. By accepting this offer, you acknowledge and accept this platform limitation.

8.4 Third-party subscriptions (booking platforms, stock image libraries, premium plugins, SSL beyond standard, etc.) are not included.

9.Ownership & Intellectual Property

9.1 Once the full fee is paid, you own the final website design, Content, and any custom assets created specifically for your site.

10.Cancellation & Refunds

10.1 As the fee is paid in full on acceptance, refunds are not available once work has commenced, except:

Work is deemed to have commenced upon receipt of payment, at which point we reserve capacity on our production schedule for your project.

10.2 If you cancel within 24 hours of payment, and before we have begun any design, scheduling, or client onboarding work, you may request a full refund, less any payment processing fees charged by Stripe.

10.3 If we cancel the project before launch (for reasons other than your breach), we will refund amounts paid for work not yet completed, as reasonably assessed by us.

10.4 Nothing in this clause limits your rights under the Australian Consumer Law, which may apply where services are not rendered with due care and skill or are unfit for their stated purpose.

11.Warranties & Limitation of Liability

11.1 We warrant that our services will be performed with due care and skill.

11.2 We do not guarantee:

11.3 To the maximum extent permitted by law, our total liability under this agreement is limited to the total fees paid by you in the 12 months preceding the claim.

11.4 We are not liable for indirect, consequential, or special loss, including lost profits, lost bookings, or loss of goodwill.

11.5 Nothing in this agreement excludes, restricts, or modifies any consumer guarantee, right, or remedy that cannot be excluded under the Australian Consumer Law.

12.Confidentiality & Privacy

12.1 We treat your business information as confidential and will not share it with third parties except as necessary to deliver the services (e.g. hosting providers, domain registrars).

12.2 We collect and handle personal information in accordance with the Privacy Act 1988 (Cth) and our Privacy Policy.

13.Offer Availability

13.1 This $500 + GST offer is available for a limited time and may be withdrawn or varied at any time.

13.2 The offer applies to new clients only and may not be combined with any other offer, discount, or promotion.

13.3 We reserve the right to decline any project at our discretion, including on grounds of scope, availability, or business fit.

14.Variations

14.1 Any variation to these Terms must be agreed in writing (email is sufficient).

15.Governing Law

15.1 This agreement is governed by the laws of Australia and the state of Western Australia. References to "business days" and "public holidays" throughout these Terms are interpreted by reference to Western Australia.

15.2 Any dispute will be resolved first by good-faith negotiation. Failing that, the parties submit to the exclusive jurisdiction of the courts of the state named above.

16.Acceptance

16.1 Payment of the fee, written confirmation by email, or signing an engagement form constitutes acceptance of these Terms.
